Sales terms governing the sale of XFlow Focus to consumers in the Czech Republic.

1. Seller

2. Scope
These terms govern the rights and obligations of the parties arising from a purchase contract concluded between the Seller and a consumer (the 'Buyer') via the website xflowfocus.com.
The legal relationship is governed by Act No. 89/2012 Coll. (Civil Code, hereinafter 'OZ'), Act No. 634/1992 Coll. (Consumer Protection Act, as amended by Act No. 374/2022 Coll. effective 6 January 2023), Act No. 235/2004 Coll. (VAT Act), and Act No. 110/2019 Coll. (Personal Data Processing Act).
XFlow Focus is a food supplement (doplněk stravy). This site complies with the disclosure obligations under § 5d Act No. 40/1995 Coll. (Advertising Regulation Act).
3. Order and conclusion of contract
The Buyer creates an order via the checkout form on the website. The order is binding when submitted.
The Seller confirms the order by email. The purchase contract is concluded upon delivery of the order confirmation to the Buyer.
Pre-contract information required by § 1820 OZ is provided through these Terms, the product page, and the checkout form. The Buyer agrees to use means of distance communication when concluding the contract; communication costs are borne by the Buyer at their standard rates.
In compliance with § 1812 OZ, no pre-checked boxes are used at checkout. Any additional payment beyond the agreed price requires the Buyer's explicit prior consent given by an active action (e.g. ticking an unticked box).
4. Price and payment methods
Product prices listed on the website are final and include VAT (where the Seller is a VAT payer).
Available payment methods:
- Cash on delivery (dobírka) — the Buyer pays the carrier upon delivery in cash.
- One-time payment by card or wallet (card / Apple Pay / Google Pay / Link), processed by Stripe Payments Europe, Limited (Ireland).
- Recurring payment by card under a monthly or yearly subscription — see § 5 below.
5. Subscription (monthly / yearly recurring purchase)
Where the Buyer selects a subscription plan, this Section applies in addition to the rest of these Terms. Pre-contract information required by § 1820 odst. 1 písm. j), o), and p) OZ:
- Duration of obligation: indefinite — the subscription continues until cancelled by the Buyer or the Seller.
- Billing cycle: monthly subscription is billed every calendar month; yearly subscription is billed every 12 months. Each billing cycle results in one bottle of XFlow Focus being shipped to the Buyer's address on file.
- First payment is taken at checkout. Subsequent payments are taken automatically on the calendar anniversary of the original payment using the saved payment method.
- Minimum duration of Buyer obligations: none — the Buyer may cancel before the next renewal at any time.
- Cancellation channel: the Buyer cancels the subscription at any time through the Stripe Customer Portal accessible from the order detail page, or by emailing support@xflowtrading.com. Cancellation is effective at the end of the current billing cycle; previously paid cycles are not refunded except where required by mandatory law.
- Price: the price applicable to each renewal is the price displayed at the time of subscribing. Price changes apply only to billing cycles starting after the Buyer has been notified at least 30 days in advance and given the option to cancel.
6. Delivery
Goods are shipped within the Czech Republic by carriers offered at checkout (currently GLS; further carriers and pickup-point options may be added).
Delivery typically takes 1–3 business days from order confirmation (or, for subscriptions, from the renewal payment).
The risk of damage to the goods passes to the Buyer at the moment the goods are handed over. Where the Buyer is not the consumer, risk passes when the goods are handed to the first carrier.
Shipping cost (where applicable) is shown at checkout before order confirmation.
7. Right of withdrawal (consumer)
Pursuant to § 1829 OZ, the Buyer who is a consumer has the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason.
Important exception under § 1837 písm. g) OZ: the right of withdrawal does NOT apply to goods supplied in sealed packaging that are not suitable for return on health or hygiene grounds once the Buyer has broken the seal. Once the bottle's safety seal is broken, withdrawal under § 1829 is no longer available. The Buyer's rights from defective performance under § 8 of these Terms are not affected.
To exercise the right of withdrawal where it applies, the Buyer notifies the Seller at support@xflowtrading.com (or via the model withdrawal form available on request) and returns the goods at their own cost. The withdrawal is effective on the day the notice is sent.
Pursuant to § 1832 OZ, the Seller refunds the price (including delivery costs at the cheapest rate offered) within 14 days of receiving the returned goods or proof of dispatch, whichever is earlier, by the same payment method or by bank transfer where agreed.
Pursuant to § 1833 OZ, the Buyer is liable for any decrease in the value of the goods caused by handling other than what is necessary to verify their nature, characteristics, and functioning.
8. Defects and complaints
The Seller is liable that the goods are free of defects on receipt. The Buyer's rights from defective performance are governed by § 2099 et seq. and § 2161 et seq. OZ, and by our separate Complaints Procedure (Reklamační řád).
A defective product can always be claimed even if the seal has been broken — § 1837 písm. g) OZ limits only the unconditional withdrawal right, not the rights from defective performance.
9. Out-of-court dispute resolution
Pursuant to § 14 of Act No. 634/1992 Coll., the Buyer is entitled to out-of-court resolution of consumer disputes via the Czech Trade Inspection Authority (Česká obchodní inspekce). More information at https://adr.coi.cz.

10. Personal data
Processing of personal data is governed by our separate Privacy Policy.
11. Final provisions
These terms are valid from the date stated above. The Seller reserves the right to amend them; previously concluded contracts are governed by the version in effect at the time the contract was concluded. For active subscriptions, any amendment less favourable to the Buyer applies only to billing cycles starting at least 30 days after notification, with the right to cancel.
